Federal Examples

Transport Canada, NSC - National Safety Code for Vehicles

In Canada, regulations governing commercial vehicles, drivers and motor carriers are based on the Canadian National Safety Code (NSC) standards. The NSC is a code of minimum performance standards, applying to all persons responsible for the safe operation of commercial vehicles. There are 15 NSC standards, ranging from commercial driver license requirements to carrier facility audits.

Canada Labour Code - Occupational Health & Safety:

14.20 (1) Before motorized or manual materials handling equipment is used for the first time in a work place, the employer shall set out in writing instructions on the inspection, testing and maintenance of that materials handling equipment.

14.23 (1) Subject to subsection (2), every employer shall ensure that every operator of motorized materials handling equipment has been instructed and trained in the procedures to be followed for (a) its inspection; (3) An employer shall ensure that every operator of manual materials handling equipment receives on-the-job training by a qualified person on the procedures to be followed for (a) its inspection; and (b) its safe and proper use, in accordance with any instructions of the manufacturer and taking into account the conditions of the work place in which the operator will operate the manual materials handling equipment and the operator’s physical capabilities.

National Standards

Canada has national standards that are used and have been adopted in all industry sectors to assist people and companies with their safety, health, compliance and performance requirements under federal and provincial laws.

Workplace Health & Safety General - Section 12 Equipment
1. An employer must ensure that all equipment used at a work site a. is maintained in a condition that will not compromise the health or safety of workers using or transporting it,  b. will safely perform the function for which it is intended or was designed,  c. is of adequate strength for its purpose, and  d. is free from obvious defects.

Section 14 Duties of Workers 2. A worker must immediately report to the employer equipment that a. is in a 'condition that will compromise the health or safety of workers using or transporting it, c.has an obvious defect.
Section 15 Safety training
1. An employer must ensure that a worker is trained in the safe operation of the equipment the worker is required to operate.
2. An employer must ensure that the training referred to in subsection (1) includes the following: a. the selection of the appropriate equipment; b. the limitations of the equipment; c. an operator’s pre-use inspection; d. the use of the equipment;

4.3 Safe machinery and equipment
(1) The employer must ensure that each tool, machine and piece of equipment in the workplace is (a) capable of safely performing the functions for which it is used, and  (2) Unless otherwise specified by this Regulation, the installation, inspection, testing, repair and maintenance of a tool, machine or piece of equipment must be carried out (3) A tool, machine or piece of equipment determined to be unsafe for use must be identified in a manner which will ensure it is not inadvertently returned to service until it is made safe for use.

SAFE Manitoba  - DUTIES OF EMPLOYERS - Further duties of employer  4(2)   Without limiting the generality of an employer's duty under subsection (1), every employer shall (a) provide and maintain a workplace, necessary equipment, systems and tools that are safe and without risks to health, so far as is reasonably practicable;
WORKPLACE SAFETY AND HEALTH PROGRAM - Establishment of workplace safety and health program  7.4(1)  An employer shall establish a written workplace safety and health program for each workplace where 20 or more workers of that employer are regularly employed. Content of program 7.4(5)   A workplace safety and health program must include  (e) a schedule for the regular inspection of the workplace and of work processes and procedures at the workplace;  (h) a plan for training workers and supervisors in safe work practices and procedures;

New Brunswick
WorkSafeNB 9(1) Every employer shall 9(1) (a) take every reasonable precaution to ensure the health and safety of his employees;  (c) ensure that his employees comply with this Act, 9(2) Without limiting the generality of the duties under subsection (1), every employer shall (a) ensure that the necessary systems of work, tools, equipment, machines, devices and materials are maintained in good condition and are of minimum risk to health and safety ..
 
Newfoundland and Labrador
Occupational Health and Safety Branch - Safety inspections 18. (1) Regular inspections of all buildings, excavations, structures, machinery, equipment, work practices and places of employment shall be made by the employer or his or her representative at intervals to ensure that safe working conditions are maintained and that unsafe conditions found as a result of the inspection are remedied without delay. (2) Where an unsafe condition is discovered by a person, it shall be reported as soon as practicable to a supervisor who shall ensure that appropriate action is taken, without delay, to prevent a worker from being injured.

Maintenance and Repair of Equipment

31. (1) An employer shall ensure that all equipment is maintained at intervals that are sufficient to ensure the
safe functioning of the equipment.
(2) Where a defect is found in equipment, an employer shall ensure that, as soon as is practicable,
(a) steps are taken to protect the health and safety of any worker who may be at risk until the defect is corrected; and (b) the defect is corrected by a competent worker or the equipment is replaced .
(3) A worker who knows or has reason to believe that equipment under his or her control is not in a safe
condition shall, as soon as is practicable, (a) report the condition of the equipment to
the employer;

PART XI - POWERED MOBILE EQUIPMENT

Visual Inspection

173. (1) An employer shall, before a worker starts any powered mobile equipment, ensure that the worker
makes a complete visual inspection of the equipment and the surrounding area to ensure that no worker,
including the operator, is endangered by the start up of the equipment.
(2) No worker shall start any powered mobile equipment until the inspection required under subsection (1) is completed.

Inspection and Maintenance

174. (1) An employer or supplier shall ensure that all powered mobile equipment at a work site is inspected
(a) by a competent worker for defects and unsafe condition; and (b) as often as is necessary to ensure that the
equipment is capable of safe operation. (3) An employer or supplier shall, at the work site, (a) keep a written record of inspections and maintenance carried out under this section; and (b) make the written record in paragraph (a) readily available

Maintenance of Powered Mobile Equipment

176. An employer or supplier shall ensure that each unit of powered mobile equipment is constructed, repaired,
inspected, tested, maintained and operated in accordance with the manufacturer’s specifications or an
approved standard.
 
Maintenance and Inspection

209. (1) An employer or supplier shall ensure that only competent persons maintain and inspect an aerial device, elevating work platform, suspended powered scaffold, personnel lifting unit or scaffold to which section 196 applies.

PART 13

HOISTS, CRANES AND LIFTING DEVICES

Standards

218. (1) An employer shall ensure that all hoists, cranes and lifting devices are constructed, inspected, tested, maintained and operated in accordance with an approved standard.

Inspections

232. (1) An employer or supplier shall ensure that a hoist, crane or lifting device is inspected by a competent person to determine whether the hoist, crane or lifting device is in safe working condition
(a) before the hoist, crane or lifting device is used at the start of each work shift; and (b) at regular intervals as recommended by the manufacturer.

Inspection of Firefighting Vehicles and Equipment

484. An employer shall ensure that (a) all firefighting vehicles and firefighting equipment are inspected by a competent person for defects and unsafe conditions as often as is necessary to ensure that the vehicles and equipment are capable of safe operation; (c) a written record  (i) is kept of all inspections carried out
pursuant to paragraph (a), (ii) is signed by the competent person

DUTIES AND PRECAUTIONS - Employers' precautions and duties 13(b) provide and maintain equipment, machines, materials or things that are properly equipped with safety devices; EXAMPLE:  Part 7 - Hoists and Mobile Equipment - General provisions - 55 An employer shall ensure that a hoist, industrial lift truck or powered mobile equipment is erected, installed, assembled, started, operated, used, handled, stored, stopped, inspected, serviced, tested, cleaned, adjusted, maintained, repaired, modified …Industrial lift trucks - 81 An employer shall ensure that an industrial lift truck (a) is designed, installed, erected, examined, inspected, operated and maintained in accordance with the applicable ASME standard listed below, where applicable, (i) ASME B56.1-1993, "Safety Standard for Low Lift and High Lift Trucks", or  (ii) ASME B56.6-1992, "Safety Standard for Rough Terrain Forklift Trucks"; (b) in addition to any inspection required by clause (a), is inspected at the beginning of each shift in which it is used to ensure it is in a safe working condition

Duties of employers

25.  (1) An employer shall ensure that, (a) the equipment, materials and protective devices as prescribed are provided; (b) the equipment, materials and protective devices provided by the employer are maintained in good condition;
Duties of supervisor
27.  (1) A supervisor shall ensure that a worker, (a) works in the manner and with the protective devices, measures and procedures required by this Act and the regulations;
 
Additional duties of supervisor

(2) Without limiting the duty imposed by subsection (1), a supervisor shall, (a) advise a worker of the existence of any potential or actual danger to the health or safety of the worker of which the supervisor is aware; (b) where so prescribed, provide a worker with written instructions as to the measures and procedures to be taken for protection of the worker; and (c) take every precaution reasonable in the circumstances for the protection of a worker. R.S.O. 1990, c. O.1, s. 27.

Duties of workers

28.  (1) A worker shall, (a) work in compliance with the provisions of this Act and the regulations;  (c) report to his or her employer or supervisor the absence of or defect in any equipment or protective device of which the worker is aware and which may endanger himself, herself or another worker; and

PART 1 SAFETY REGULATIONS

Material Handling

51.  (1)  A lifting device shall, (a) be so constructed, of such strength and be equipped with suitable ropes, chains, slings and other fittings so as to adequately ensure the safety of all workers; (b) be thoroughly examined by a competent person to determine its capability of handling the maximum load as rated,(i) prior to being used for the first time, and (ii) thereafter as often as necessary but not less frequently than recommended by the manufacturer and in any case, at least once a year, and a permanent record shall be kept, signed by the competent person doing the examination;

CONSTRUCTION PROJECTS – PART II

PART II -EQUIPMENT, GENERAL

94.  (1)  All mechanically-powered vehicles, machines, tools and equipment rated at greater than 10 horsepower shall be inspected by a competent worker to determine whether they can handle their rated capacity and to identify any defects or hazardous conditions. O. Reg. 145/00, s. 26.
(2)  The inspections shall be performed before the vehicles, machines, tools or equipment are first used at the project and thereafter at least once a year or more frequently as recommended by the manufacturer.  O.Reg.145/00, s. 26.

30.3 (4) The employer shall ensure that machinery is regularly inspected for defects and machinery which could cause injury to employees is removed from service until repaired. (EC180/87)

PART 31

REPAIRS TO MACHINERY

31.1 The employer shall ensure that all power-operated machinery shall (a) be carefully inspected as far as is practicable each day before being operated;

34.5 (1) The employer shall ensure that hoisting apparatus is maintained in good condition.
(2) The employer shall designate a competent person to thoroughly inspect and test hoisting apparatus including safety devices
(a) before it is first put into use;
(b) once a month;
(c) after any happening involving the hoisting apparatus which could have damaged some part of the apparatus.
(3) The employer shall ensure that a log book recording inspections and repairs is maintained and made available to an officer on request.

§2.  Hoisting devices
245.  Operating conditions : Every hoisting device shall be used, maintained and repaired in such a manner that its use does not compromise the health, safety or physical well-being of workers. Consequently, such a device shall
  (1)    be inspected before it is used for the first time ;
  (5)    be inspected and maintained in accordance with the manufacturer's instructions or standards offering
          equivalent safety ;
 
251.  Mobile crane : A mobile crane shall meet the requirements of the CSA Z150-1974 Safety Code for Mobile Cranes standard and its supplement no 1-1977, or any other recognized standard offering equivalent safety.

254.1.  Training  of the overhead travelling crane operator : An overhead travelling crane must be operated exclusively by an operator who has received theoretical and practical training given by an instructor.
The theoretical training must cover, among other things,
 (5)    the inspection to verify the working order and proper functioning of the overhead travelling crane and hoisting accessories prior to operation by the operator; and

256.  Lift truck : A lift truck built starting on August 2, 2001 shall conform to the ASME B56.1-1993 Safety Standard for Low Lift and High Lift Trucks.
A lift truck built before August 2, 2001 shall conform to the CSA B335.1-1977 Low Lift and High Lift Trucks standard or the ANSI B56.1-1975 Low Lift and High Lift Trucks standard.

263.1.  Aerial basket lifting device - training : Every worker operating an aerial basket lifting device must undergo training in compliance with articles 10.11 to 10.11.3 of CSA Standard C225-00 Vehicle-Mounted Aerial Devices and more specifically on the operating methods related to the operation in motion of the carrier vehicle of the aerial basket lifting device.

§4.  Self-propelled vehicles
272.  Conditions of use and maintenance : Every self-propelled vehicle shall be used, made and repaired in such way that it does not compromise the health, safety and well-being of workers. Consequently :
(3)    the vehicle shall be maintained and inspected in accordance with the manufacturer's instructions or standards offering equivalent safety ;

DIVISION  XXXI

TRANSPORTING WORKERS
 
359.  Application of the Highway Safety Code : Any automobile used for transporting workers shall be arranged and used in compliance with the Highway Safety Code (R.S.Q., c. C-24.2) and its regulations, except insofar as they are modified under this section.

361.  Other safety standards : The vehicle used for transporting workers shall : (2) be examined and maintained so as to protect the health and ensure the safety and physical well-being of workers.

156 An employer or contractor shall ensure that:
(a) all powered mobile equipment is inspected by a competent person for defects and unsafe conditions as often as is necessary to ensure that it is capable of safe operation;
(b) where a defect or unsafe condition that may create a hazard to a worker is identified in the powered mobile equipment:
(i) steps are taken immediately to protect the health and safety of any worker who may be at risk until the defect is repaired or the unsafe condition is corrected; and
(ii) as soon as is reasonably practicable, the defect is repaired or the unsafe condition is corrected; and
(c) a written record of the inspections and maintenance carried out pursuant to clauses (a) and (b) is kept at the place of employment and made readily available to the operator. 4 Oct 96 cO-1.1 Reg 1 s156.

PART XIII

Hoists, Cranes and Lifting Devices
Inspections

216(1) An employer, contractor or supplier shall ensure that a hoist, crane or lifting device is inspected by a competent person to determine whether the hoist, crane or lifting device is in safe working condition:
(a) before the hoist, crane or lifting device is used at the start of each work shift; and
(b) at regular intervals as recommended by the manufacturer.

229 An employer or contractor shall ensure that all rigging and components of rigging are inspected thoroughly at appropriate intervals and visually inspected before use to ensure that the rigging and rigging components will safely perform the intended function of the rigging and rigging components. 4 Oct 96 cO-1.1 Reg 1 s229.

CRANES, HOISTING AND LIFTING

GENERAL

Inspection, Maintenance and repairs

5.07 Cranes and hoists shall be inspected and maintained, as specified by the manufacturer’s manual, unless otherwise approved by the original equipment manufacturer or a professional engineer, and records kept of the inspections and maintenance.
Start of shift inspection 5.27 (1) An operator shall inspect the crane or hoist at the beginning of each shift and test control and safety devices as specified by the manufacturer and these regulations. (2) Any defects found during inspection or use of a crane or hoist shall be recorded in the inspection and maintenance record system and reported immediately to the supervisor, who determines the course of action to be taken.

PART 6 – MOBILE EQUIPMENT
START OF SHIFT INSPECTION

Inspection 6.30 (1) The operator shall inspect the mobile equipment before the start of operation on the shift and thereafter as required to ensure the safe operating  condition  of the  equipment
 (2) The operator shall report defects and conditions affecting the safe operation of mobile equipment to the supervisor as they are noticed

Closing Notes

1/You can clearly see here that every person who operates any equipment, machine, vehicle or device, especially if they are powered, has a legal obligation to inspect, document and report the condition to the appropriate personnel, whether there is a defect or not. The employee is legally bound to report the good or defective condition of the unit they are to use or operate. That is a key employee responsibility.

2/The inspection must be documented – remember the old rule: “If it’s not in writing, it didn’t happen”! To protect everyone, it must be in writing in order to prove the event, in this case, INSPECTION.

3/ The employer has a clear legal obligation to implement any safety requirement, standard, rule or regulation in their workplace that would improve and enhance safety and help eliminate injuries to improve their health and safety initiatives and performance.

4/ There are rules, regulations and standards for inspection requirements in every industry in CANADA and in every Province that apply to your workplace and work environment or operations. The employer has the legal mandate and obligation to implement them.

5/ Pre-Use / Pre-Trip, Post-Use / Post-Trip Inspection, Documentation, Reporting & Monitoring of these Inspection requirements is a Mandatory Legal Obligation in all Industries & Operations in CANADA!
